PTB 2010 needs close scrutiny by policy makers

PVCHR welcomes the decisions of several political parties and their members in the Rajya Sabha to bring amendment motion for removing shortcomings in the Prevention of Torture Bill, 2010 by referring it to the Select Committee.

Immediately, after Lok Sabha passed the bill on 6 May 2010 in a hurried manner, Peoples' Vigilance Committee on Human Rights (PVCHR) sent an open letter  to the Prime Minister, India,(http://pvchr.blogspot.com/2010/07/prevention-of-torture-bill-2010.html) and all members of the Parliament(http://testimony-india.blogspot.com/2010/07/open-letter-to-member-of-parliament-on.html), citing a comparative analysis done by PVCHR and Rehabilitation and Research Centre for Torture Victims (RCT), Copenhagen-Denmark showing what the present bill offers and what the UNCAT desires. The analysis, clearly proved how the bill not only falls short of the specifications of the UNCAT but also greatly replaced protection of perpetrator instead of victims.

While meeting several Members of Parliament and important leaders of the national and regional political parties, PVCHR came across stories of torture suffered by some members.  Not surprisingly, they still carry the sense of humiliation suffered in the hand of state agencies.  There is a huge relief to know, that the present bill has come under scrutiny. PVCHR feels, that people who are instrumental  in drafting such a bill, perhaps have not internalized the growing anger rooted in the state's inability to give 'justice' to the victims, across the country. The bill in its present form would have further alienated the victims and undermined the common man's trust in the state.

PVCHR on its part will continue to inform the Honorable Members about its understanding of the Prevention of Torture Bill, 2010 and suggest areas that need greater attention as well press for a wider public consultation, so that, the bill helps preventing torture effectively.

Dear All,

The hunger strike of Dr. Lenin Raghuvanshi has finished after an hours when the grant of Rupees 1975334.43 was transferred in the account of Jan Mitra Nyas. The C.O Mr. Narsh and D.G.M has offered juice to Dr. Lenin and his colleges, who were also with himi. As on 23rd August, 2010 RCT has transferred the grant and it credited in the account of Jan Mitra Nyas today late afternoon around 3:40.

 

This shows again the satyagrah win!

Realization of solidarity in Honour Ceremony


After hearing his testimony Abdul Rahman started crying and the eyes of the people presented in the hall become wet and they became unvoiced. Few people initiated to economically support for his operation.

 

The honor ceremony for the survivor of police torture and bonded labour was organized on 14th August, 2010 in Madarsa Usmania in front of police chowki, Bazardiha (weaver's colony) in Varanasi. The program started at 11:30 with the recitation of Aayat (versus) of Holy book Quran by the priest of the Madarsa and prayed for the salvation of the two martyr of police firing[i]. The participation of people from different religion belief provided moral support to all the primary and secondary survivor of the police firing.

 

The testimony of the five survivors was read to the public and the survivors were honored with the testimony and traditional white shawl. The name of the survivors is Mr. Abdul Rahman, Mr. Wasim Akram, Mr. Anup Chaubey, Mr. Ram Dayal[ii] and Mohd. Jahid Ansari

 

Among the victims were two youth Abdul Rahman and Vasim Akram were natives of Bazardiha locality, who had been injured in police firing in the locality during Holi festival on March 11, 2009. Both of them skilled weavers till the day they were injured.

 

Anup Kumar Chaubey, a native of Chaubeypur is a victim of Kacheri bomb blast of 23 November, 2007. He worked as a munshi of the lawyer. He received a compensation of 50,000 Rupees from the state government. However he is yet to get any financial assistance from the centre.

 

The other persons including Mohammed Zahid Ansari alias Mangru of Phulpur was victims of alleged police torture and Ram Dayal Mushar of Sarai village was harassed by his master.

 

The basic objective behind organizing this honor ceremony was to instill confidence among the survivors and motivates them to fight for justice. They raised their voice and demanded justice.

 

The program ended by giving vote of thanks by the secretary of Madarsa Kari Mohd. Mustaq.
