These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 11.3.2015. This Commission called for a report from the concerned authorities upon the complaint of the complainant Dr. Lenin Raghuvanshi wherein it is alleged that Bundelkhand being the most backward part of the country having backward caste population of 53%, Scheduled Caste 25%, Tribals 10%, remaining 12% are Thakurs and Brahmins. There is a rampant caste based discrimination, sexual exploitation and untouchability. The women of the Valmiki community manually dispose of human faeces and carcasses of dead animals. Violence against women is rampant. There is large number of cases of domestic violence and deaths. The child sex ratio is also alarming. In village Kalothara Block, Talbahet of Lalitpur in UP, if Thakur came in front, then dalit need to bring their shoes in hand. It is extreme form of atrocities on Schedule Caste people. The Chief Secretary of UP was directed to submit the report and DG(I) of NHRC was also directed to get the fact investigated from the team after visiting Lalitpur. DG(I) constituted a team under Shri S.N. Pandey, Deputy SP comprising Shri Rajbir Singh and Shri Lal Bahadur, Inspectors. The Govt. of UP directed the DM, Lalitpur to make thorough investigation and report. The SP, Lalitpur also submitted a report. Commission has perused the report submitted by the administration and the Deputy SP, Shri S.N. Pandey of NHRC. All the facts mentioned in the complaint have been more or less denied by the administration. No case of any atrocities upon the Schedule Castes and Schedule Tribes have been reported. Shri S.N. Pandey in his report confirms the allegation that dalit women carry their shoes in their hands when they move through the locality of the upper caste people. The team has observed two such incidents during its visit but the team found that it is not done out of compulsion from forward class people. The dalit women carries their shoes in their hands in front of the elderly people even of the dalit community. If they do not do so, the elderly people of the dalit community may complaint to their husbands for not removing shoes by their wives in front of the elders of the community. This appears to be a case of customs prevalent in the dalit community which has received the social sanction. The team of the NHRC recommended to issue directions to the Chief Secretary, Govt. of UP for taking effective, preventive, educative and awareness generating measures to eradicate this social evil in which a dalit women carry their shoes in hands when they move in front of the elderly and upper caste people as it is against the dignity of the women. The Govt. of UP should strictly comply the provision of the PNDT Act and guidelines of the Hon’ble Supreme Court issued in the petition filed by the Centre for the Enquiry of Health and Allied Themes and the Mahila Sarrangeen Mandal and Dr. Sabu George, as the sex ratio in the area is alarmingly imbalanced. On examination of two reports, this Commission directs Government of UP to take effective measures to prevent this social evil of carrying shoes in hand by woman when they moves in front of elderly and upper caste people. The Government of UP shall appoint a senior officer to conduct a thorough enquiry to find out if the women’s of the dalit community are taking of their shoes out of compulsion or fear from the upper caste people or under pressure from the elders of their own community. An awareness programme should be organized in whole of the Bundelkhand region to eradicate this evil for upholding the honor of the women’s of the dalit community. Large scale publicity should be made to stop this illegal practice. Government of UP also take steps to educate women’s of the dalit community about their human rights. This Commission further directs the Government of UP to make on the spot enquiry regarding the cause of imbalance in sex ratio in the region and shall take immediate steps to check the female foeticides. The Chief Secretary, Govt. of UP shall submit action taken report to this Commission within ten weeks.

Anandpal Singh police encounter in Churu: The criminal was killed after being on the run for nearly one and a half years.
Jaipur: Notorious criminal Anandpal Singh who had been on the run for the past one and a half years was killed in a police encounter late on Saturday. He was found hiding in the house of an aide Shravan Singh in Malasar village of Churu. Anand Pal fired nearly 50 rounds of bullets on the policemen when they tried to surround the house he was hiding in and arrest him alive. Circle inspector Suryaveer Singh had a fracture in his hand while another policeman Sohan Singh sustained bullet injuries in the waist. He was admitted in Jaipur’s SMS Hospital. Another policeman, Dharmpal, sustained bullet injuries on his leg.

The police encounter took place nearly 11.30 pm on Saturday.Bullets pierced Anand Pal Singh’s body during the exchange of fire between him and the police, killing him on the spot.

The cops are learnt to have recovered two AK-47 guns and 400 bullets after the encounter. Nearly 50 policemen of SOG and quick response team (QRT) were part of the operation.
The news of his encounter spread quickly in the state. In some areas of Didwana and Ladanu in Nagaur district, people even congratulated each-other, terming the encounter a much-awaited justice for the broad daylight murder of Jeevan Goadara, Harphool Jat and Pappu Meghawal. The murders took place in Godara Maket of Didwana on June 27, 2006. Anandpal’s name had cropped up in the sensational murder case.
Anandpal’s fans vent out their anger on social media channels, prominently Facebook which is being used for running many fake pages of Anandpal. “We are proud of your Anandpal”, ‘RIP Anandpal’, and ‘We would take revenge’ are some of the messages being shared on Facebook.

A few hours before the encounter, the special operations group (SOG) arrested his two brothers Devendra alias Guttu and Vikki from Sirsa in Haryana.
During interrogation with the two brothers, it came up that Anandpal Singh was hiding in the house of one Shravan Singh in Churu’s Malasar village.
A team of SOG had been camping in Haryana under the supervision of IG, SOG Dinesh MN for the past one and a half months. The team nabbed Vikki and Guttu from Sirsa around 6 pm on Saturday.

After their brief interrogation, police came to know that Anandpal was hiding in Shravan Singh’s house for the past two days.
A team led by add SP Karan Sharma was immediately rushed to Malasar.
The team surrounded the house, but Anandpal Singh and his aides came to know about the presence of cops. They climbed on the rooftop and started firing, using AK – 47.
Anandpal allegedly fired nearly 50 rounds of bullets.
At the time of his encounter, he was clean-shaved. He is known for keeping beard, but police officials said that he became clean-shaved to disguise himself.
Anandpal had fled from the police custody on September 3, 2015 while he was being taken to Ajmer high security jail from a court hearing in Nagaur’s Ladanu town.
Near Parabatsar town in Nagaur district, Anandpal’s gang members opened fire at the policemen escorting the criminal and helped him escape. Anandpal took away an AK-47 that belonged to the police.
In the past one and a half years, the SOG and Nagaur police arrested more than 100 people, mostly members of Anand Pal’s gang, but the criminal remained elusive. While more than 60 people have been released on bail, the remaining people are still behind bars.
Nearly five months after his escape in Parbatsar, Anand Pal was allegedly chased by Nagaur police, but he allegedly opened fire at the police party, killing a policeman Khumaram.
Anandpal Singh was carrying a cash reward of Rs 5 lakh on his head.
Home minister Gulab Chand Kataria said that the encounter was inevitable because Anandpal used automatic guns to open fire on policemen.

There were reports that the family members of Anandpal have demanded a CBI probe into the matter alleged in a fake encounter. They also demanded that Anandpal’s two brothers who were arrested should be given the opportunity to attend his last rites.
DGP Manoj Bhatt said that Anandpal was asked to surrender several times, but instead he opened fire and engaged the police in a gun battle. The police had to fire in self defense.
A resident of Sanwrad village in Nagaur’s Ladanu area, Anandpal had political ambitions. He had fought in local panchayat elections. He entered the world of crime after he got involved in illegal liquor trade and came in direct conflict with criminals who were already into this business.

The Commission has come across a distressing newspaper report dated 21.10.2015 published in the 'Indian Express' captioned '2 Dalit kids burnt alive in revenge killing by rajputs in faridabad'. According to the report, two children (Vaibhav aged 3 years and Divya, nine months old) of a Dalit family died and their parents suffered burn injuries after their home was set on fire, allegedly by upper caste rajputs in Sunpedh village, Faridabad. The Commission took cognizance of the matter and called for reports from the concerned authorities. Pursuant to the directions of the Commission, The Dy. Commissioner, Faridabad, vide communication dated 19.12.16 has informed that an amount of Rs.5,62,500/- has been given by the District Welfare Officer, Faridabad to Shri Jitender, father of the two deceased children, as per the relevant rule of SC/ST(POA) Act. It is further informed that the District Administration has also provided the medical help to the victims through Red Cross Society, Faridabad. The District Red Cross Society, Faridabad has paid an amount of Rs.49,759/- against the bills duly verified by the doctors to the next of kin of two deceased children. Ambulance service was also provided eleven times to the victims for dressings and regular check up at Safdarjung Hospital, New Delhi. The DGP, Haryana vide communication dated 20.01.17 has informed that as per the action taken report received from Commissioner of Police, Faridabad a case FIR No. 325 dated 29.10.15 u/s 147/149/452/432/302/307 IPC and 3/33/89 SC/ST(POA) Act was registered at PS, Ballabhgarh and the same is being investigated by the CBI. An amount of Rs. 5,62,500/- has been paid to Shri Jitender, father of deceased dalit kids as compensation. As per written statement of Shri Jitender, a total amount of Rs.Ten Lakhs has been received by him as compensation from District Welfare Officer, Faridabad. The Commission has considered the reports. The Commission is satisfied with the action taken by the District Administration and Police and decides to close the case along with the linked files.

SUNPED (Ballabhgarh): The deaths of two children and the burn injuries suffered by their mother and father when their house was set on fire in Sunped village in Ballabhgarh has brought the simmering tension between Dalits and upper castes in Haryana to the forefront once again. In Mirchpur in 2011 and in Bhadana in 2012, Dalit families had been forced to flee their homes after being targeted by musclemen belonging to upper-caste communities.

On Tuesday, as news about the death of three-year-old Vaibhav and eight-month-old Divya, children of Jitendra Kumar and his wife Rekha, went around, the unrest among the reserved community was palpable. Hundreds of Dalit men and women from neighbouring villages thronged Sunped throughout the day.

"We have been suffering at the hands of the upper caste for years. They abuse us and harass our daughters. Today, they killed innocent infants. We cannot tolerate this any longer," said Ram Prakash, a Dalit boy from Sahupur village who had reached Sunped to show his solidarity with Kumar's family.
Sunped village has around 500 houses, of which around 50 belong to Dalit households. The Thakurs, who are alleged to have set Kumar's house on fire over an old feud, are the dominant community. Recalling the lingering tension, Lal Chand, Kumar's neighbour, said, "On October 5 last year, a fight ensued when a group of Thakurs ordered Dalit boys, including Kumar's younger brother, to pick up a mobile phone from a drain. In the altercation, three Thakur men were killed." Caste relations have remained tense since then.

With this history, the police had to quickly post around 500 policemen in the village on Tuesday even as the atmosphere became fraught with the visit of political leaders, including former Haryana CM Bhupinder Singh Hooda, and Dalit leaders like BJP MP from North-West Delhi Udit Raj and Rajya Sabha member Ramdas Athawale, who offered their support to victim's family.

Kumar, who suffered burn injuries on his hand while trying to save his wife and children, was inconsolable. His 80-year-old mother was in shock and repeatedly murmured, "Mujhe mere bacchhon ke paas bhej do. Mujhe bhi maar do."

Santosh, a family member, said that in addition to the year-old acrimony over the mobile phone, what had also got the Thakurs' goat was the election of Kumar's relative as sarpanch of the village a few years ago. "Since it was a reserved seat, he won. But the upper caste community never forgot the humiliation," Santosh said.
