Girl stands up to elders, refuses to marry ‘rapist’

"Rape survivors are generally encouraged by community elders (as well as police) to compromise with the family of the accused by dropping charges or marrying the accused. But, in this particular case the rape survivor refused and sent her 'would be husband' behind the bars. The girl has set an example for others," said human rights activist Lenin Raghuvanshi of People's Vigilance Committee on Human Rights (PVCHR).

Interface with different stakeholder on women rights


लखनऊ, 24 मार्च अंतर्राष्ट्रीय दिवस International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims के अवसर पर मानवाधिकार जननिगरानी समिति एवं सावित्रीबाई फूले महिला पंचायत, द्वारा वायस ऑफ पीपुल, क्वालिटी इंस्टिट्यूटशनल केयर अल्टरनेटिव फॉर चिल्ड्रेन, के संयुक्त तत्वाधान एवं डिग्निटी – डेनिश इंस्टीट्यूट अगेंस्ट टार्चर के सहयोग से  सरकारी व गैर सरकारी विभिन्न हितधारक संगठनों के साथ महिला अधिकार विषयक संवाद कार्यक्रम 24 मार्च,2015 (मंगलवार) को होटल गोमती, हजरतगंज लखनऊ में आयोजित किया गया|

संयुक्तराष्ट्र जनरल असेम्बली द्वारा 21 दिसम्बर 2010 को 24 मार्च को International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims के रूप में अनुमोदित किया गया| कार्यक्रम की रूपरेखा पर प्रकाश डालते हुए संस्था की मैनेजिंग ट्रस्टी श्रुति नागवंशी ने कहा कि इस कार्यक्रम का  मुख्य उद्देश्य समाज में महिलाओं को उनके अधिकार एवं सेवाओं को प्रदान करने वाले सरकारी एवं गैर सरकारी हितधारक संगठनों को तकनीकी गतिरोधों,समस्याओं को दूर करना है| इसके साथ ही साथ सरकारी एवं गैर सरकारी हितधारक संगठनों को जोड़कर महिलाओं को उनके अधिकार प्राप्त करने में विभिन्न हितधारक संघठनों को सक्रिय करने में सरकार के साथ सहयोगात्मक प्रक्रिया चलाना है| समाज में लिंग आधारित भेदभाव के मुद्दे पर संस्था के महासचिव डा० लेनिन रघुवंशी ने कहा कि हमारे समाज में ज्यादातर लिंग भेदभाव व हिंसात्मक गतिविधियों की ट्रेनिंग हमें बचपन से ही मर्द होने के रूप में मिलती है | लेकिन राज्य सरकार ने प्रदेश में 2006 से State Women Policy बना कर महिलाओं के हित में काफ़ी अच्छा प्रयास किया है| जिसके हर सुझाव को अविलम्ब लागू किया जाना चाहिये|महिलाओ को दबाकर रखने वाली ताकतों के खिलाफ निरंतर सामूहिक संघर्ष करना होगा|प्रदेश सरकार चाहती है कि जो भी सामाजिक, राजनैतिक, आर्थिक, बौद्धिक और सांस्कृतिक संसाधन समाज के पास है|उनका समाज के सभी वर्गों में न्यायपूर्ण पुर्नवितरण पर जोर दिया जाये ताकि महिलाओ को उनमे बराबरी का हक मिल सके|

कार्यक्रम की मुख्य अतिथि एवं राज्य  महिला आयोग की उपाध्यक्ष सुश्री सुमन यादव जी ने कहा कि महिलाओं को समाज में हर जगह चाहे वह परिवार, कार्यस्थल या समुदाय कहीं पर भी हो, महिलाओ को निर्णय लेने,समान अधिकार, शिक्षा, रोजगार का बराबर अवसर मिलना चाहिये| महिलाओं, बच्चों व अल्पसंख्यकों से जुड़े हुए केसों को मानवीय आधार पर संवेदनशीलता से देखने के लिए, महिला व बाल मित्र प्रशासनिक व पुलिसिंग व्यवस्था बनाने हेतू वरीयता अनुसार विभिन्न हितधारक सरकारी व गैर सरकारी संगठनों, संस्थाओं को विशेष प्रशिक्षण दिया जाना चाहिये| राज्य बालक संरक्षण आयोग की सदस्य और समाजसेविका सुश्री नाहिद लारी जी ने कहा कि आज समाज में बच्चों व महिलाओं पर यौनिक हिंसा, बलात्कार, सामूहिक अत्याचार की घटनाएं बड़ी तेजी से बढीं हैं| ऐसे में पुलिस विभाग, होम्स, संरक्षण गृह को अधिक ज़िम्मेदार व संवेदनशील बनाया जाना आवश्यक है| जिससे किसी पीड़ित महिला-लड़कियों, बच्चे को समस्या के समय गैर ज़रूरी व अमानवीय प्रश्न पूछकर प्रताड़ित नहीं किया जाना चाहिये| मोहम्मद कमर आलम, चेयरमैन, उत्तर प्रदेश महिला प्रशिक्षण एवं नियंत्रण बोर्ड ने कहाकि हम महिलाओं के साथ उत्पीड़न करीबी लोगो के जरिये ही होता है | लड़िकयों बोझ समझा जाने लगा है, बहुओ   बेटी का दर्जा देने में आज भी हमारी सोच संकीर्ण है |
उत्तर प्रदेश आवास विकास परिषद के उपाध्यक्ष श्री.सिद्धार्थ सिंह जी ने कहाकि हम देख रहे है कि समाज में जागरूकता का काम एनजीओ बढ़चढ़ कर कर रही हैं किन्तु अभी भी काफी प्रयास किये जाने कि आवश्यकता है | निदेशालय महिला कल्याण चीफ प्रोटेक्शन ऑफिसर श्री. डी. वी. गुप्ता ने कहाकि सरकार महिला एवं बाल विकास कार्यक्रमों के समर्थन में कई योजनाएं संचालित कर रही है जिससे महिला और बाल अधिकारों को संरक्षण की दिशा में काफी बदलाव हुए हैं | स्टेट लीगल सर्विस एथारिटी से उपसचिव श्री. राजेशपति त्रिपाठी ने प्री लीगल सर्विस सेल के सन्दर्भ में जानकारी देते हुए बताया कि लीगल सर्विस एथारिटी द्वारा महिलाओं को निःशुल्क मदद प्राप्त कर सकती और न्याय और प्राप्त कर सकती हैं | रेडियो कार्यक्रमों के बारे में विस्तार पूर्वक बताते हुए महिलाओं को क़ानूनी जागरूकता और शिक्षित होने के लिए प्रेरित किया |     
सीनियर मैनेजर डा० राजीव सिंह ने लड़कियों एवं महिलाओं के साथ शिक्षा में भेदभाव के मुद्दे पर गंभीरता से प्रकाश डाला| संस्था के सीनियर मैनेजर अनूप कुमार श्रीवास्तव ने आम समाज में पीड़ितों के साथ पुलिस यातना, पुलिस की कार्यशैली एवं अंग्रेजी तानाशाही कार्य प्रणाली पर काफी गम्भीरता सेअपनी बात रखा| सावित्रीबाई फूले महिला पंचायत की शिरीन शबाना खान ने समाज में बढ़ते बलात्कार एवं यौन उत्पीड़न एवं उसके सामाजिक,सांस्कृतिक, आर्थिक और राजनैतिक कारणों पर बहुत सूक्ष्मता से प्रकाश डाला और सरकार को गंभीरता से प्रयास करने पर बल दिया| QICAC की राज्य समन्वयक सुश्री विनिका करोली ने महिला गृहों एवं बाल सुधार एवं संरक्षण गृहों में रह रहे बच्चों की स्थिति पर बहुत संवेदनशील अनुभव साझा किया| स्वास्थ्य अधिकार कार्यकर्ता मंगला प्रसाद ने ग्रामीण व पिछड़े अंचलों में ग़रीब महिलाओं की स्वास्थ्य समस्याओं पर गहन प्रकाश डाला| समाज  में बंधुआ मजदूरों की स्थिति और उनकी समस्याओं पर शिव प्रताप चौबे जी अपनी बात रखी| महिलाओं पर बढ़ते घरेलू हिंसा व पुलिस-थाना में शिकायत में भेदभाव, छेड़छाड़, बलात्कार जैसे विषय पर छाया कुमारी ने बहुत बारीकी से प्रकाश डाला| विदित हो कि समिति राज्य के विभिन्न प्रभावी संस्थानों एवं सरकार के साथ अपनी रिपोर्ट को साझा करेगी| जिससे जमीनी स्थितियों में सकारात्मक बदलाव व सुधार किया जा सके| कार्यक्रम में उoप्र० के विभिन्न जिलों  से यातना पीड़ित भी शामिल रहे और अपनी बात रखी | कार्यक्रम में मुख्य रूप से अजय सिंह, पंकज सिंह, ब्रिजेश सिंह, ताहिर, रागिनी, संध्या ,विनोद, विजय, रोहित, होप, हेनरिक शामिल रहे | अंत में कार्यक्रम में धन्यवाद ज्ञापन कार्यकर्ता इरशाद अहमद ने किया|   
Peoples’ Vigilance Committee on Human Rights (PVCHR) and Savitri Bai Phule Women Forum (SWF) in collaboration with VOP and QIC - AC with support from DIGNITY: Danish Institute Against Torture are observing the International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims as an Interface with different stakeholder on women rights on 24th March, 2015 in Hotel Gomti, Hazratganj, Lucknow.  


On 21 December 2010, the United Nations General Assembly proclaimed 24 March as the International Day for the Right to the Truth concerning Gross Human Rights Violations and for the Dignity of Victims.

The purpose for organizing this interface to discuss the discrepancy between the provisions of law, its effective implementation and challenges faced with different stakeholders. As Government of India has signed and ratified numerous international human rights instruments and has also adopted numerous progressive laws and policies at the Union and State levels. Numerous laws, including amendments to existing laws, have been enacted to address various manifestations of violence against women. Among others, these include: the Indian Penal Code which broadly includes crimes against women. This law includes the crimes of rape, kidnapping and abduction for specified purposes, homicide for dowry, torture, molestation, eve teasing, and the importation of girls, among others.

In 2006 the state Government stated  State Women Policyप्रदेश सरकार की मान्यता है कि यदि महिलाओ को समर्थ बनाना है तो महिलाओ को दबाकर रखने वाली ताकतों के खिलाफ निरंतर सामूहिक संघर्ष करना होगा| प्रदेश सरकार चाहती है कि जो भी सामाजिक, राजनैतिक, आर्थिक, बौद्धिक और सांस्कृतिक संसाधन समाज के पास है उनके न्यायपूर्ण पुनवितरण पर जोर दिया जाये ताकि महिलाओ को उनमे बराबरी का हक मिल सके| प्रदेश सरकार महिलाओ के उत्पादन और पुनरोत्पादन श्रम को व काम और संपत्ति पर उनके समान अधिकार को मान्यता देती है| हर     क्षेत्र                                                                                                                                                                                                        में चाहे वह परिवार, कार्यस्थल या समुदाय हो, महिलाओ को निर्णय लेने के समान अवसर देने को भी मान्य करता है| इसके अलावा ज्ञान प्राप्त करने के समान अवसर, जीने का अधिकार और बालिकाओ के लिए समान अवसर को भी स्वीकार करता है|

राज्य की महिला नीति ऐसा वातावरण बनाने का प्रयास करेगी जिसमे महिलाओ के ज्ञान योगदान को स्वीकार किया जाये, महिलाये भयमुक्त हो, उनका आत्मा सम्मान एवं गरिमा बढे| जमीन संपत्ति पर उनका नियंत्रण बढे, वे आर्थिक रूप से स्वालंबी बने| जमीन संपत्ति पर उनका नियंत्रण हो वे शिक्षित हो और उनका कार्य बोझ कम हो| उनका कौशल दक्षता बढे और वे अन्य महिलाओ के साथ संगठन बना सके |  परिवारों में समुदाय में उनकी परंपरागत भूमिकाओ सकारात्मक रूप से बदले तथा निर्णय लेने की प्रक्रिया में उनकी बराबर की भागीदारी हो | (The state government believes that if women are to be empowered then there is a need for sustained struggle against the forces that suppress women. The state government aims to focus upon justified re-distribution of available social, political, economic, intellectual and cultural resources so that women get their due share in the same. The state government gives due important to women in production labour, work and property. In all areas whether family, workplace or community, the right to take decision has been upheld. Apart from this acceptance is also to pursue education with equal rights, right to life, and equal opportunity for the girls.

The state’s women policy will tend to make an environment where knowledge and contribution by women is accepted, women are free and fearless, and their self-respect increases. Their control on land and property increases, they are educated and their work load reduces. Their skill and aptitude increases and they can form organization along with other women. Their traditional role in the family and community gets changed with optimism and they have equal right in decision making.)

https://ssl.gstatic.com/ui/v1/icons/mail/images/cleardot.gifWe believes that violence from women “Womb to Tomb” from selective abortion, effects of battering during pregnancy or on birth outcomes, female infanticide, physical, sexual and psychological abuse, domestic violence, dowry deaths or harassment, mental and physical torture, trafficking, and humiliation, honour killings and forced suicide or homicide of widows. Most of these are for economic reasons as well as sexual, physical and psychological abuse.

We intervened and provided psycho – social support through testimonial therapy, meta – legal intervention, scholarship to continue further education, self –economic sustainability of women through vocational training, legal and other type of emergency support (short stay shelter), awareness. We identified the issues of witch hunting in Uttar Pradesh We also positively contributed our submission before various committees for changing in policy and making laws. 

So, in this conference the survivors and activists will share their self – suffering and experience in dealing issue such as Education, Health, Rajbhar, Bonded Labour, Sexual abuse, Domestic Violence, police torture, Juvenile homes and Masculinity.

Recommendation:

  1. To give priority to the training of various stakeholders such as police, court personnel, government and private social workers, child welfare committee members, Protection Officer, Juvenile Justice Board, lawyers, Probation Officer and doctors etc to sensitively handle complaints so that they do not re-traumatize victims by aggressively questioning the victim or family members. This should include training of junior ranks that have most public dealings at police stations or as first response units.
  2. Establish mandatory training for investigating officers regarding gender-based crimes. Training should include investigative methods applicable to sexual and domestic violence, including working with traumatized victims, protecting victims from harassment, and collecting and preserving evidence.
  3. Appoint qualified and independent individuals to serve as nodal officers such as child welfare committees and Protection officer under ICPS, Protection officer under Domestic Violence Act, 2005, Juvenile Justice Board. Adopt standard operating procedures and ensure that the committees have sufficient resources for members to carry out all their responsibilities, including mandated inspection of all residential care facilities related to women and children. Ensure that professional counselling services are available for them that have suffered sexual abuse.

  4.  Ensure that offices are safe and suitable for interviewing women and children and that potential nodal officer do not have conflicts of interest. Trained all child welfare committee, Juvenile Justice Board members, protection officer and Labour department in conducting inspections and interviewing children before they take up their posts.

  5. The grass – root implementation of Domestic Violence Act through appointment of Block level Protection Officer and providing all facilities mentioned in the Act because due to lack of financial condition many women are unable to register their complain.

  6. To give priority to the single women, widow, divorce and women who faced domestic violence and living with their parents in all government schemes.

  7. To convert family court as fast track court in all district of Uttar Pradesh to deal with pending cases which will provide justice to women at earliest and will ensure to build healthy society.

  8. To enact state law against witch hunting. Witch hunting involves the branding of women as witches, mostly after an ‘ojha’ or witch doctor confirms that a woman is a witch. A woman who is branded a witch is then subjected to numerous forms of torture: beatings, burns, being paraded naked through the village, being forced to eat human excrement, raped, having wooden or sharp objects inserted in her private parts.

  9. To organize regular health camp in rural area and appoint bare – foot health worker doing health awareness.
  10. To provide vocational and technical training to the most marginalized women for their economic sustainability and to prevent violence against women.

  11. Specific focus on providing psychological support to the survivors of rape and sexual abuse. To provide technical and vocational training to these women and children as their rehabilitation to adjoin them with mainstream of society.

  12. To increase health budget from 3 – 6%

  13. To ensure the availability and functionality of health infrastructural facilities including the medical and Para-medical staff in PHCs/SCs. There is an urgent need to emphasise the systemic mechanism of supervision, monitoring and review of the functioning of primary health care institutions.

  14. To ensure appoint of two regular ladies doctors at Primary Health Care Center. Ensure the most marginalized girls are benefited with the Sabla program, Rastriya Kishori Swasthya Karyakrum and beneficiary of other government health schemes.

  15. To ensure proper infrastructure in Government school such as labotary and to organize health camp in school with adolescence girls for taking health and hygiene care

  16. Ensure that all institutions related to women and children are subject to regular and periodic inspections, and institute regulation of residential care facilities that includes independent and confidential interactions with women and children and staff. Provide this information to Women and Child Development.

  17. Draw up guidelines for schools and other educational institutions to prevent the sexual abuse of children, as directed by the Juvenile Justice (Care and Protection of Children) Rules, 2007 and Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 

  18. Implement guidelines to ensure that all institutions understand their responsibilities for preventing child sexual abuse, sexual harassment and for taking appropriate action when it is found. Display the helpline number in all common highlighted places.

  19. Require all institutions housing children to provide age-appropriate information to children, and inform them about their rights and complaint procedures. Each institution should have a board of counselors whom children can easily approach. Require all institutions to present information on each child to the child welfare committee, as the child is admitted and released.

  20. Create multidisciplinary centers in at least one government hospital in every district or, when not practical, in a facility located according to an appropriate population-to distance norm, staffed with trained personnel and equipped to provide integrated, comprehensive, gender-sensitive, and child-friendly treatment, forensic examinations.

  21. Ratification of UNCAT and rehabilitation policy for the survivors of Torture and organized violence

  22. To ensure the appointment of a doctor to be available to the women prisoners on daily basis and one gynecologist and a child specialist to visit the women’s wards.
  23. Right to education to the children who are living in different prisons of Uttar Pradesh along with their mothers.
