New Delhi: The National Human Rights Commission (NHRC) on Tuesday issued notices to Uttar Pradesh Chief Secretary and Director General of Police regarding the arrest of a senior journalist who reported about the death of deputy CMO Y S Sachan.
Issuing notices, the NHRC asked the Chief Secretary and DGP to submit detailed reports in the matter within a week.
A spokesperson said the Commission received two complaints regarding the arrest of bureau chief of a Hindi TV channel after he reported about Sachan's death saying that the injuries could not be self-inflicted.

violation of human rights of the victim and issued notices to the Chief Secretary and Director General of Police, Government of Uttar Pradesh calling for their detailed reports in the matter within a week," he said.
Earlier, the Commission, on the death of Sachan in judicial custody, had issued notices to the Chief Secretary and Senior Superintendent of Police, Lucknow calling for their reports in the matter.
It had also directed the District Magistrate and Superintendent of Jail, Lucknow to explain as to why the intimation about the death in custody was not reported within 24 hours to the NHRC, as per its guidelines.

The National Human Rights Commission, NHRC has taken cognizance on complaints alleging that Bureau Chief of IBN-7 News Channel was picked up by police personnel after the Channel reported about deceased Dy. C.M.O. Y.S. Sachan's injuries could not be self-inflicted.

The Commission received two complaints in the matter, one from Mr. Lenin Raghuvanshi, Secretary General, PVCHR/JMN, Varanasi and another from Mr. R.H. Bansal, Chief Editor, Human Rights Observer, Delhi on the 27th June, 2011.

The Commission observed that the allegations framed by the complainants, if true, raise serious issues of violation of human rights of the victim and issued notices to the Chief Secretary and Director General of Police, Government of Uttar Pradesh calling for their detailed reports in the matter within a week.

Earlier, the Commission, on the death of Dr. Yogendra Singh Sachan, Deputy CMO in judicial custody, had issued notices to the Chief Secretary, Government of Uttar Pradesh, District Magistrate and Senior Superintendent of Police, Lucknow calling for their reports in the matter. It had also directed the District Magistrate and Superintendent of Jail, Lucknow to explain as to why the intimation about the death in custody was not reported within 24 hours to NHRC, as per its guidelines.

LUCKNOW: In an alleged attempt to gag the media for the recent coverage of rising crime graph in the state, Hazratganj police on Sunday night rounded up Shalabh Mani Tripathi, the bureau chief of IBN-7 news channel. He was released after an hour.

But scores of journalists marched up to the CM's residence on Kalidas Marg around midnight to register their protest against police high-handedness.

Tripathi was rounded up from a fast food joint in Hazratganj. Police claimed that his driver had misbehaved with a police constable's wife and when the cops present there tried to stop him, Tripathi retaliated aggressively and was, therefore, detained.

However, the move, coming immediately after the channel's report about the government's medico legal cell official's comment that injury marks on the body of deputy CMO YS Sachan, who was found dead in the jail, could not have been self-inflicting, raised a question mark over the police action.

Tripathi says he was picked up by SP (East) BP Ashok and another officer whom he did not recognize by name. The two senior cops even ordered their subordinate to thrash him to 'teach a lesson'. But the constables did not oblige.

He was released only after some journalists reached the police station and started seeking reason for Tripathi's detention.

We, the Regional Convention at Lucknow, Uttar Pradesh in India, desiring that State embodies the aspirations of the People, aver the need for greater efforts for promoting the sovereignty of the People through democratic values and structures based on nonviolence and justice.
We uphold social democracy and economic equity through sustainable development.
We advocate optimum and equitable utilization of resources for the benefit of the people, providing them adequate forum to influence and participate in decisions on natural resource use and management.
We reaffirm the inalienable right of the People of India to basic needs including food, clothing, shelter, health, education, social security and productive work as dignity of labour.
Democracy

We cherish and uphold the Rule of Law, sovereignty of the people, a system of governance that ensures devolution of power, People's right to self rule and control over natural resources.
We advocate full independence of the judiciary, adhering to internationally recognized values and principles. People beneficial lawmaking process has to be participatory, representative and fully transparent.

Demand laws and their enforcement in regard to bonded labour,child labor , sexual harassment, discrimination based on caste & gender and attack on minority.
We resolve for an immediate and effective end to untouchability, the worst form of discrimination and demand interventions as follows to take in politics:
·         Programs for the uplift of the Dalits and mechanisms to empower them for defend their rights.
·         Reservations(affirmative action), in public as well as the private sector, to ensure participation of all at all levels starting from primary schooling and across all spheres of life.
·         Reservations to enable at least 33% representation of women in all spheres of private and public life.
·         Discrimination to be considered a real life problem.
Review of existing laws and modifications to incorporate the implementation of international instruments.
·         To implement the recommendation of report of Sachchar' Committee[ii] and Justice Rangnath Mishra[iii] on Muslim minority.

We believe the right to food is a fundamental right and must be assured through guarantees to equality in work, justice, uniform minimum wages and land reform.

UP cleaner deaths: NHRC issues notice to state chief secy

The National Human Rights Commission (NHRC) has issued notices to the UP Chief Secretary and the Lucknow Municipal Commissioner, asking for a detailed report within four weeks on the incident in which two young men were killed here after inhaling poisonous gases while cleaning an underground drain.
The youths were sent to clean the drains without face masks or any other safety equipment.
The commission has stated that in case of default, it would proceed to take such action as it deemed proper.
The commission took action on a complaint by Mohan Lal Panda, Advisor of People's Vigilance Committee on Human Rights. The complaint drew attention of the commission to the news report in The Indian Express on Friday, which stated that two men, Asgar Ali and Mahboob Ali, died in Lucknow when they were sent down to clean an underground drain without proper equipment. The incident took place on Thursday in front of the residence of PWD Minister Naseemuddin Siddiqui on Vikramditya Marg, a VIP area, and less than a kilometre from the Chief Minister's residence.

Taking the reference of new published in Times of India on 14th June, 2011 "Hope dries in parched land: 515 suicide in five months" Peoples' Vigilance Committee on Human Rights (PVCHR) on 15th June, 2011 sent email to Honb' Chief Justice, Allahabad High Court[i] and Chairperson[ii],  National Human Rights Commission, New Delhi with the following given below demands:
 

1.   Immediate relief schemes should be implemented.

2.   Widely publicity of the plan

3.    To reduce the caste based feudal  abuse Bundelkhand

4.   Special Tribunal for the settling the dispute of the land without delay.

5.   The public hearing of the problem faced by the small and  marginal farmers at block level  and their problems should be settled immediately.

6.   The forgiven of the debt of the farmer through the debt list.

7.   Strict action should be taken on lenders.

On 16th June, 2011 it published in the Times of India and Amar Ujala that Hon'b High Court took suo moto and directed central and state governments to submit a status report before it by July, 15. The bench of Justic Sunil Ambani and Sabhajeet Yadav also issued directives to the state government, nationalized, private and co-operative banks and Khadi Gramodoyog Development Board not to take any coercive step to recover agricultural loans from farmer  in Bundelkhand region till July, 15

       Times of India ने उ0प्र0 संस्करण ने अपने प्रथम पृष्ठ पर एवं अमर उजाला ने अपने सम्पादकीय में उत्तर प्रदेश के बुंदेलखण्ड क्षेत्र स्थित 7 जिलों में 5 माह में 519 किसानों की आत्महत्या की बात प्रकाशित की है।
       अतः अविलम्ब निम्नवत् कदम उठाये जाय :-
1-   फौरी राहत की योजनाओं को लागू किया जाय।
2-   योजनाओं का व्यापक प्रचार-प्रसार किया जाय।
3-   बुंदेलखण्ड के जाति आधारित सांमन्ती उत्पीड़न को कम करने के उपाय किया जाय।
4-   स्पेशल ट्रिब्यूनल जमीनों के विवाद को अविलम्ब निपटाने के लिए किया जाय।
5-   सीमान्त व लघु किसानों को समस्याओं के लिए जन सुनवाई को आयोजन प्रखण्ड स्तर पर करके उनकी समस्याओं को अविलम्ब निपटाया जाय।
6-   बैंक से कर्ज की लिस्ट लेकर किसानों का कर्ज माफ किया जाय।
7-   साहूकारों पर कड़ी कार्यवाही की जाय।

Why civil disobedience is the best way to destroy a corrupted political regime (The Indian case)

India used to call her selves as the "world's largest democracy". Theoretically, this is true. The election game empowering the people to elect their leaders through the representative system and, by this way, seems makes them the real holders of political power. But in the practical level, this pretending democracy revels themselves as a political regime where money is actually the main base of power. In political sciences, we call this kind of political regime: a plutocracy.
In such state, all reforms and progressives changes are paralyze by corruption. It is for this reason that corrupt practices are often linked with conservatism society, in which those possessing wealth become the only holders of the political power and are the only ones able to influence the political games. On the other hand, peoples who occupy official positions made confusion between private and public interests. It fallows from this that all this system is based on a cliental relation's game, where officials works for themselves instead of serving interests of Indian people – as they are supposed to do.
For this reason, it is difficult to ask to peoples who take advantage of the system to reform it. Furthermore, many leaders will argues that India is a youth democracy and that it takes times to changes such practice because "the establishment of a true democracy requires a long apprenticeship". But during the time that those leaders "learns by doing" and continue to invoke the time constraint, they benefit of this long "transition time" to full fit their pockets before retirement.
Actually, the main problem when corruption becomes the base of a political system: is that it works too well.
But simple solutions exist, even if many people often argue that it is a "complex problem". In Hong-Kong for example, they have created an independent commission against corruption (ICAC) who was able to eradicate a wide part of such practice. This experiment – and others – clearly emphasizes that the end of a corrupt system first of all depends of the strength of the political will.
In India, many associations and organisations try to put a term on corrupt practices. But what can they do in front of a system so effective? As long as they'll have enough money to feed this clientelism[i] network, it will be impossible to destroy it in order to establish a true democracy. Because clientalism relations are based on a "give to give" relation where money is exchange to obtain power and vice versa.  
It is also interesting to note that the incomes of public money that which allows the system to persist mainly come from tax paid by citizens. Lots of political leaders are actually using public money to maintain their position in the system or increase their power, and many officials – in the police or administration – take directly money on the people's wallet. So, in the both situation, it is always the citizen who pay the bill.
In a way, we can say that it is the honest Indian tax's payer who feed this corrupted system witch paradoxically destitute him/her from his/her right to govern the country through the representative democratic system.
For this reason, it seems that the best way to avoid corruption in official offices is to refuse to pay tax anymore until government takes effective measure to ban such practices. What better way to destroy a system based on money that shut off the money tap to grind the wheels well-oiled of the system? Without incomes money, it's all the machinery that will breaking out. It is for this reason that a civil disobedience movement lead by citizens who refuses to pay taxes anymore seems to be the faster way to destroy a plutocracy trough a democratic action.
But a civil disobedience movement is not a means of political pressure as another. Using that kind of method supposed to understand that it is an ultimate resource for the case where all the others attempts have failed. It requires also an education of the masses in order to avoid inappropriate behavior and remain a nonviolent practice. Gandhi-ji has well understood that when is launched his hartal in 1919. For him, it was important to start from an inner individual change before looking for external public result. It is for that reason that he asked for a national hunger strike days during the hartal.
Civil disobedience movement has also the advantage to involve directly the people on a political issue. Even on a representative system, it is indeed important to involve au maximum those who are supposed to have the power. There is an old saying that goes "if you do not go to politics, politics will come to you". That means that peoples have the chose to act or just react, and if they don't want to make their own choice other peoples will choices for them.
But people should also know that refuse to pay tax is dangerous and that the citizens who accept to be part of this struggle risk to face sever repression, especially for the lower caste. For all that, it is important that peoples who choice to be part of this process accept to keep respect the others laws and refuse to use violence. This is maybe the most important thinks because the aim of such movement is to establish a true democracy, which must necessarily be based on respect for the rule of law. It is therefore important to understand the scope of this choice and accept its consequences – as example prison sentences.
A true democracy should also be based on a secular state who allows freedom of worship and multi-confessionality. That means that religions, as a personal believe, should remain in the private sphere of people's lives and there should be a strong separation between temporal and spiritual power. It is clear that it is not the case in India. For this reason, we don't need religious political protest such the hunger strike launched by Baba Ramdev (who is a spiritual leaders and should not interact on political issues) or the launch of a satyagraha (nonviolent protest) by the Sangh Parivar, an Hindu ultra nationalist movement. This is the people of India, as citizen of this country and not as religious representing, which we need to improve the system.
Finally, it is important to finish this civil disobedience proposition by mentioning the fact that corruption is one of the biggest problems in India. Many others issues that face the country can't be solving – or takes a lot of times to be solved – because of this hierarchical system of private interest. A Corrupted system supposed to be based on a rigid pyramidal organization of society in which each stage of power take its little part of the money cake by shifting the financial burden on the shoulders of citizens who are on the bottom of the social hierarchy. This is for this reason that everybody is concern by this issue and that the best way to establish a true democracy is a united public action who involving all the forces of the society. A collective and unitize action in the respect for all diversity.

GOVT HOSPITAL'S NEGLIGENCE - OVER 18 PATIENTS HAVE DIED IN LAST 03 DAYS IN 4 WARDS (TOTAL 20 BEDS) IN LNJP HOSPITAL, NEW DELHI LEAVING BEHING ONLY 5 PATIENTS NOW - Ms. Rehana (M-9718356570) a relative of IPD patient Shaukeen (C.R.No.952581) in Medicine Ward No. 28, IInd floor of LNJP Hospital, New Delhi has just informed me that there are in total 20 beds in 4 Wards at IInd floor and in the last 3 days over 18 patients have died due to hospital's negligence which is causing grave fear in the left out 5 patients including patient Shaukeen.
 
Please take action under article of 21 of Indian Constitution.

Open letter to Chief Minister of Uttar Pradesh against the threat for rule of Law


Respected Bhahan Ji,

On 4th June, 2011 Dainik Jagaran in page no 9 published " Shak Ke ghere mein NGO" (NGO in the circle of doubt) and wrote three days before one  NGO produced the cognizance to district administration regarding 12 bonded labour in the brick kiln factory situated in cholapur and which became counterfeit. SDM gave the order to Tehsilar for the enquiry against the NGO.

It is known that on 31st May, 2011 Nanhu, Asha and Ram Awatar of Musahar community came to my office and I personally spoke to them in detail. Afterwards on 1st June, 2011 affidavit of Puspa, Munna, Ram Avatar, Asha and Nanhu was written before the District Magistrate. http://www.scribd.com/doc/57067129/Affidavit-of-bonded-labour   I did all these things as the member of the district vigilance committee on bonded labour under Bonded labour Act 1976 and I am also Executive Director/Secretary General of Peoples' Vigilance Committee on Human Rights (PVCHR) So, I took the help from the PVCHR activist Mr. Shiv Pratap Chaubey to take the runaway bonded labour to meet with the district administration.

These people went to the office of Hon'b ADM (Administration) office. After reading the testimonies as affidavits and taking with the bonded labour, he immediately send them to the SDM Sadar, Mr. Vivek. On SDM instruction, Nayab Tehsildar (sri Ragvendra Singh) and Labour office did raid the brick kiln factory.

After raid Nayab Tahsildar (a Revenue officer) gave 500 Rs conveyance to the bonded labour to return back to home. Sri Shiv Pratap Chaubey took Mushars to the office of SDM.  In this context on 2nd June, 2011 a daily newspaper Hindustan published "5 families were released from brick kiln" which write on the information of Dr. Lenin and direction of SDM, Sadar revenue department liberated 5 bonded families from the brick kiln factory in Gosaipur in evening.

After getting threat from SDM, Mushars became afraid. On my personal request PVCHR activists provided psychological support through testimonial therapy to the fearful labours. In the statement it is clearly stated about the ill –treatment and getting forceful signature on the paper. Together with them the testimony of other labour were taken.

In the judgment given by honorable Supreme Court in the case of Neeraja Chaudhary vs. State of M.P on 1984. It is clearly stated that often big official send Tehsildar and he directly ask question – are you bonded? When the advance is given or any economical obstacle is should be believed as bonded.

If you look the news published on 4th June, 2011 newspaper which wrote problem about less reimbursement of wages and 56 thousand as advance to workers. It is the clearly case of bonded labour as mentioned under judgement of judgment given by honorable Supreme Court in the case of Bandhuwa Mukti Morcha vs. Government of India.

Hon'b  SDM instead of doing enquiry on the Bonded Labour System (Abolition) Act, 1976, Payment of Wages Act, 1936; Minimum Wages Act, 1948; Prevention of Scheduled Castes and Scheduled Tribes (Atrocities) Act, 1989; Interstate Migrant Workmen (Regulation of Employment and Conditions of Services) Act, 1979; Contract Labour (Regulation and Abolition) Act, 1970; Child Labour (Prohibition and Regulation) Act, 1976; and Weekly Holidays Act, 1942 is giving threat to member of the district bonded labour vigilance committee, colleagues of his organization and bonded labour. Now the news is published in the newspaper to suppress the fact and defamation it and giving threat for the indirect enquiry.

In such condition I am putting my resignation in this context from membership of District committee on Bonded labour with the given below demands –

o   To conduct high level enquiry and take appropriate action for the entire circumstances.

o   Provide security to the labours.
