PVCHR central office has received information from its local PVCHR unit of Ambedkar Nagar District based in Uttar Pradesh. Hunger sallows the life of three people in same family in Mubarakpur municipality Ambedkar Nager district.

Case Detail.

Kanhaiya Lal Gupta son of Misri Lal Gupta 32 years old residing in Mubarakpur municipality ward no-04 Tanda tehsil Ambedkar Nager District. Kanhaiya Lal Gupta is living with his three children and younger brothers and his old age mother.


• Suman Devi age 15 years daughter of Kanhaiya Lal
• Munna age 6 years son of Kanhaiya Lal
• Ravindra age 3 years son of Kanhaiya Lal

Earlier Kanhaiya Lal run two-power loom due to the irregularity distribution in electricity he earns only 6 to 8 Rupees in whole day. The wages is so less after weaving one-meter tericott clothes he only earns one and half Rupees. When he did not find work then he engage in parelling the stone of wheat mill and earn 50 Rupees in a day. Due to irregularity in his present work he earns three hundred Rupees in a month. Kanhaiya Lal lost his half middle finger while parelling the stone of wheat mill. From last three month he is unable to do any work.

Kanhaiya Lal is homeless and now he is living in his relative house. Kanhaiya Lal relative sells his house to Aftab Alam Khan and he is making pressure on Kanhaiya Lal to vacant this house as soon as possible. Kanhaiya Lal Gupta has above poverty line (yellow) card so, Kanhaiya Lal is unable to buy ration at cheap price to fetch his family. Kanhaiya Lal hardly manages one time food for his family member.

Kanhaiya Lal’s wife Jai Mala died on 8th November, 2007 after delivery of the child. Jai Mala was physically very weak and suffering from Anemia which is also one symptom of malnutrition as during her advanced phase of pregnancy Jai Mala did not get nutritious diet as prescribed for the pregnant women. She eats only when food is left after providing food to every member of the family. Jai Mala has some complication during delivering child and in lack of medicine she lost her life.

Twenty three days baby of Kanhaiya Lal died on 30th November, 2007 due to diarrhea as child was not getting sufficient milk and medicine as he was physically very week. Kanhaiya Lal took child for the treatment in private hospital. Due to economic poverty child has lost his life.

Sundari Devi ten years old daughter of Kanhaiya Lal Gupta get faint and she gets treatment in nearby private doctor. She return back to home approximately at eight PM in the night she vomit worm the condition of Sundari become critical due to lack of treatment she died on 1st December, 2007 morning. Kanhaiya Lal did not do the funeral ceremony of her younger daughter he lost his one more daughter. Sundari Devi was starving from last one week.

Kanhaiya Lal Gupta is also taking care of his old mother and she is also not doing any work. Bhure Lal mother is entitled for old age pension. Kanhaiya Lal Gupta is supposed to be paid a nominal sum of money as old-age pension. The pension is distributed to the aged persons in the state by the government so that they receive some financial help in the absence of any pension from former employment. This pension distribution is a venue of high degree of corruption. Several persons like Kanhaiya Lal Gupta mother do not receive any pension even though they are entitled to it.

Manoj Singh Grass root activist of People’s Vigilance Committee on Human Rights gave 10 k.g of ration to Kanhaiya Lal Gupta.

After hearing death of three people in same family District magistrate Mr. Ajay Kumar Upadhaya and CDO Mr. T. N. Shukla went to the victim house. District Magistrate assured to improve his economical condition of the family. District Magistrate of Ambedkar Nager ordered to Tehsildar give all help to the sorrow family. Kanhaiya Lal gets 1200 Rupees and some ration and also District Magistrate Mr. Ajay Km. Upadhaya assured employment for one person in this family.

Background information:

Mubarakpur is municipality in Tanda Tehsil. This place is famous for Tanda terikat clothes and product is exported to all over India. Whole area depends on weaving and there is no alternate employment for them. National Thermal Power Corporation is situated at Tanda Faizabad Road, which is approx. 8 km far from Tanda which all units are working and power generation is being done.
This district was formed by the then Honorable Chief Minister Ms. Mayawati on September 29, 1995. The district was named Ambedkar Nagar in the memory of the Father of the Constitution, Dr. Bhim Rao Ambedkar for his work done for the upliftment of the depressed classes, women and other weaker sections of the Society. Primary Health center is five Kilo meter and Government school is one and half Kilo meter far from Mubarakpur.
After several cases of malnutrition and hunger death in various village of Ambedkar Nager district then also Anganwadi workers and ANM are denying their duty and responsibility. They are not identifying malnourished children and adding them to their center and not immunizing pregnant mother and child.

Therefore I urge you to do intervene in this case so; life of other person living in the family of Kanhaiya Lal may be safe and Article 21 of Indian Constitution Right to life may be safe and Anganwadi centre should be opened in every ghetto as order given by the Honorable Supreme Court in a Public Interest Litigation (WP No. 196/2001) filed by PUCL.

The plight of India's caste-bound poor
LENIN RAGHUVANSHIPublished: April 17, 2008VARANASI, India, The Musahar community in northern India is socially and economically one of the country's most marginalized communities, and the poorest of the poor. It falls under the category of a "scheduled," or untouchable, caste.
Although the practice of untouchability is a crime under Indian law, the Musahar community is not allowed to enjoy ordinary social life with mainstream society or to share the common amenities of the village.

People from the Musahar community are deprived of property, a means of livelihood and education. To survive, they work as laborers in the fields or do other forms of hard physical labor. The remuneration for such work is given in kind, mostly discarded food or grain. Thus they have no savings in times of need, and are forced into starvation at times when they have no regular work.

In such a situation the Musahar community largely depends upon the public distribution system to get subsidized grain. But due to corruption in the bureaucracy and an almost defunct judiciary, often weaker sections of society are denied grain in the villages because the distributor can easily get away with malpractice.

The Musahars are estimated at between 500,000 and 700,000 in Uttar Pradesh. Exact figures are not available as they are included in the scheduled caste category in the state but were not counted separately in the last census. They are estimated to be close to 3million in Bihar.

These landless communities, traditionally dependent on forests, were slowly pushed from these areas as forests were nationalized and depleted and a land-based economy took over. These communities without resources found themselves at the mercy of the landed classes, which exploited them as bonded labor for weeding, harvesting and clearing the fields. The work of clearing the fields of rats and later using the grain from the rats' burrows may have given them the name Musahar -- musa-rat and ahar-diet -- hence people whose diet is rats.

The Musahar community was further pushed toward pauperization as lands were divided and harvesters were introduced. With the forests out of bounds they also lost their supplementary income from supplying leaf plates during marriages and community events.

Brahmins, Thakurs and Yadavs are the main landholders in the area, while the Musahar community has very little land. In five villages I visited in Uttar Pradesh and one in Bihar, only 25 percent of the people in two villages had land and the average land holding was not more than one or two acres. They got this land when the Land Ceiling Act was implemented in 1976. But in 75 percent of cases the people did not have control over their land, as the original landholders had managed to get stay orders from the court. Also, their land tends to be stony, not irrigated and far from the villages.

The Musahars work as agricultural laborers for the landholding castes and mainly do weeding and harvesting work. The men earn 40 rupees (US$1) a day, and the women 25 rupees (60 cents) for harvesting and even less for weeding work. This is far below the minimum wage of Uttar Pradesh, which is 100 rupees (US$2.50). Both these jobs are seasonal and provide employment for not more than three months in a year.

The rest of the year they work as casual laborers, earning not more than 40 to 60 rupees per day. Many work in brick kilns for 70 rupees a day, but none of them are skilled enough to do the work of a fireman, which is highly specialized work.

In the lean agricultural season the Musahars migrate to other parts of the country, traveling to New Delhi or Punjab, where they work as casual laborers in the construction industry, earning not more than 70 to 80 rupees a day and barely surviving. Some of them go to Jaipur, where they are employed in small textile businesses to color the cloth and earn up to 100 rupees per day.

All these jobs are in unorganized and underpaid sectors that provide a mere pittance to a vast pool of migrants. None of them are able to break the cycle of bondage and poverty.

The family back home survives on the casual labor and also on debts. Marwaris and Brahmins are the main moneylenders in the area. Their interest rates are not less than 10 percent and mount up to 15 or 20 percent. Such debts bind the people in permanent bondage.

The status of Musahars is so pitiable, they do not even own the land on which they have built their huts. They stay on the outskirts of villages, without electricity, proper roads, water or sanitation. In spite of their numerical strength, in many villages of eastern Uttar Pradesh they are reduced to inconsequential status as they are neither organized into voting blocks nor do they have resources such as land or money or skills with which to raise their position in society.

Traditionally the Musahars voted for the landed class who were their masters, represented by the Congress Party, but in the last state election they shifted their allegiance to the Bahujan Samaj Party. Still, this shift has largely gone unnoticed in a state where the highest numerical group, the Chamar caste, has joined with the second highest, the Brahmins, to form a winning alliance.

The community which has been left behind by society thus finds itself at the tail end of all government schemes. As one of the poorest groups, with no sustainable livelihood options and constant food insecurity, they should have been entitled to receive the maximum benefit from government food schemes. But this is not the case.

The public distribution system was initiated in India decades ago to help the poor and marginalized sections of society. It is a system through which the government distributes rationed items at subsidized prices. However, the shop owners and licensees who manage the system do not distribute the items to the poor, rather they sell them on the black market to private hotels.

Dealing in rationed items is a crime under the provisions of the Essential Commodities Act, 1955. However, it is for the local police to register and investigate crimes. But the police fail to do their duty owing to massive corruption and the rationed items never reach the needy.

The longstanding question is why do people who are enjoying the privileges of good social and economic conditions dig into the resources earmarked for the poorest of the poor?

This is possible only because of the endless division of Indian society on the basis of caste, and because of institutionalized corruption. The centralized, complex and obscure nature of the bureaucracy leaves no place for transparency at any level; even the judiciary is no exception. In such a situation, the state police have been reduced to a uniformed, top-to-bottom corrupt force paid from the government exchequer.

This is why, in spite of several judgments and directions from the Supreme Court of India regarding the right to food, the judgments have failed to change the status quo.

Why they are supporting the upper caste hindus who have linkage with anti-dalit Rajendra Tiwari or they are not giving the right to choice to their family members? Look under mentioned forwarded email, in which campaign on rachana abused me and police department started inquiry against cyber crime.

Why development agencies supporting the this type of hypocrat? Rachana caught by police and she told that she ran away due to lack of right to choice in family.

But contrary, from our organization 4 people went to participate in protest for Rachana even I did fax and forward email, but in reaction of my email which is based on friendly contradiction; you are alleging me that I retrenched the Dalit workers and sexually harassed one woman staff of my organization.



It is really amazing that through email you are saying so-called truth but why the name of campaigner and the address is not mentioned? It realized that it is defaming, assassination of my character and I am sending petition to DGP, UP for the enquiry under IT Act 2000.



Now come let us do scientific evaluation on the basis of facts :



1. Let see news published in Amar Ujala on 23rd September, 2003 (annexure 1) in the meeting of VOP General Secretary Mr.Dhirendra and Mr.V.K Rai were present and they protested and criticized the defamatory attempts by district administration and employers of bonded labour on VOP secretariat member, Dr. Lenin. Speaker said it is conspiracy to weaken the people's concern. When time comes defamer will get correct answer.

From this we can see in VOP meeting V.K Rai with Bindu and Dhirendrea accept the attempt of defamation of me through district administration and employers of bonded labour.

It is noted that after that in very important meeting of VOP as a historical event, I proposed an extraordinary move to remove Dhirendra from the post of GS of VOP and it was passed with majority. After that on 18th December, 2003 I wrote letter to Dhirendra that he and his Gangs with good connection with RSS people attack on my organization. It is well known that GS of VOP, Mr.Dhirendra received fifty one thousands rupees as advance for work of VOP from Jan Mitra Nyas, a public charitable trust of us and till date it was not returned.



As you wrote in letter that I terminated Dalit staffs, but till today I terminated two workers from upper caste after the investigation by an independent team and decision making from policy body of organization. Yes, people who are born in upper caste and OBCs Hindus associated with RSS accused me of harassment after giving resignation during the year 2003. These people formed an organization "Manav Vikas Evam Uthan Samiti" before giving resignation. The list of Management team is attached. (Annexure 2) On third number Mr. Shashi Dhar Issar Ji is and who is editor of Gandiv news paper and every body in Varanasi knows that he has very strong relation with RSS, a force of Hindu Fascism who is believe on line of Hitler. On second number on management committee is Lata Ji who is wife of ex-employee Mr.S.K Shah. Mr. S.Shah gave resignation on 8th October, 2003. (Annexure3) He wrote in his resigning letter that" My reason for resigning has nothing to do with the functioning of PVCHR/JMN or the behavior of my colleagues or the management of the Trust. I have no regrets and no complaints but I am very glad and satisfied that I got the opportunity to work two years in your esteemed organization. I have learnt a lot and will put them to very good use. -----------------However now, I have to leave, to join the Ram Janma Bhoomi Movement and work for the establishment of a Hindu Rashtra , in Akhand Bharat, So that the Hindu Society, can face the challenge and threat of Islamic Fundamentalism which I know will soon engulf our society."



Today in your email you accused me of the same charges which were clearly mentioned in the resignation letter of Salv Kumar Shah (S.K.Shah) on 8th October, 2003. Salv made sign of Swastik (Sign of Nazis) with map of India below his signature. You repeated the same charges in your email who were accused by followers of Hitler. It is noted that propaganda secretary of Hitler told," Tell a lie hundred times and convert it as truth in society".

It is well known that on 18th December, 2003 I wrote letter to Dhirendra alleging him that he is having relation with those people. It is also necessary to disclose that V.K. Rai and Dhirendra are running organization named "Vihan" and they are working together. On second side in the leadership of Salv, ex-staffs associated with RSS treated me badly in an office meeting for hanging photograph of Dr. Bhim Rao Ambedkar Saheb in our office. I always faced ill-treatment many times, because I accepted Dr. Bhim Rao Ambedkar as role model and accepted Buddhism.



Please note the news published in Hindustan Times on 4th August, 2002 which mentioned that my email Id and password was changed by one of staff. (Annexure 4)

I complained in NHRC. On my complain under case no. 18391/24/2002 – 2003 NHRC judgment was given in my favor. I wrote in my website (www.pvchr.org) "Our's truth have obviously been 'a thing contrary to the interest of men / women that have dominion' in our society .Therefore, we have never lacked for enemies who have been busy refuting, misrepresenting & vulgarizing us over the last many years. But we have suffered equally, perhaps more, at the hands of friends -- they have brought much grist to mills of enemies through their dogmatism, scientism, economism & much else besides."

It is clear that due to my Dalit perspective I was attacked both from inside and outside, and which is continuous going on.



2. It is written in your email, "it is a general belief that great problems and sorrow ness unite sufferers." You know that we are suffering with great problem. On raising the voice of hunger and malnutrition, I received threat on 4th December, 2007. Press conference of me on 8th December, 2007 was published in news paper. (Annexure 5)

This was not too sufficient even Chief Minister Bahan Mayawatiji in press conference on 4 December 2007 opposed my organization in the case of hunger and Times of India published a report. (Annexure 6)

After that Rajendra Tripathi alias Rajendra Tiwari filed case in Phulpur police station against me, three women activists and one Dalit activist of our organization under section 505 B IPC. AHRC and Frontline release Urgent Appeal.

I surrendered my self in court but I did not receive any email except Utkarsh Sinha after the alert by Sant Vivek Das. AHRC and NDHR participated in our protest in Varanasi and support us. Some persons from our sector in UP gave telephonic support but not a single letter of support come to me, why? It is very clear to under stand the "politics of solidarity by upper caste Hindus" and its philosophical followers are going on. When I am suggesting you for the formation of real unity for solidarity then you are reminding me the charges of sexual harassment and indirectly threaten through instrument of character assassination. As you are unaware that till now I did not get any written complained of sexual harassment. In our organization already committee is formed under guideline given by Honorable Supreme Court in Vishkha case. That committee did not receive any complain like that. Why you are using secret contrivance of rumor like Chanaykya and Hitler and imposing so called charges on me?


It is clear that people like you want to hide real debate. My prediction is right that all upper caste Hindus is using every secret contrivance for the holding of power in the field of NGOs and people's movement such shrewd, power hungry and opportunist people, after squeezing the Kabir Movement, Socialist movement, Gandhian movement, Communist movement have targeted NGOs sector---both as funders and implementers. . It is well known that in the leadership of Mr.Dhirendra with close collaboration of Mr. V.K Rai under the banner of VIHAN organized meeting in Baragaon and Rajendra Tiwari was chief guest. He was mentioned as famous social worker by VIHAN. (Anne.7, cutting of Dainik Jagaran news on 15 Feb., 2007) Mushar -Nut Adhikar Manch condemned such a move. (Annexure 8). It is clear that a person, Mr. Rajendra Tiwari who is charge sheeted in bonded labour Act. He is implementing caste system with force and his associate was charge sheeted in giving threat of my life for raising voice of democracy in panchayat election and now he is involved in case against us(PVCHR) under 505 B IPC.Therefore it is proved that he has direct relation with VIHAN. On the raising voice on the politics of solidarity by upper caste Hindu, their supporter framed same allegations against us which were framed by RSS supporters in 2003. It is well known that all so called allegations imposed on me were proved as wrong in the independent investigation. At that time in 2003, no resign from Dalits staffs was done but OBCs and upper caste Hindus staffs gave resign, who protested against the putting the photographs of Dr. Ambedkar in our office. And last resignation letter of S.K.Shah (Salv Kumar Shah) broke the all cloud of conspiracy by RSS supporters.


We can see when Bahan Santoshi was sexually abused then a social activist Mr.Kranti Bhusan with other workers were on hunger strike on 21 – 22- 23 January, 2008 and V.K Rai did not support them. But communist party supports them. After that V.K Rai gave statement on Santoshi and after that Rachana disappeared. In this struggle we are with V.K Rai but with my protest based on our thought on politics of solidarity and his linkage with Rajendra Tiwari. But attacking with Hitler and feudal style on friendly contradiction is fascist thought. Why the Email ID the name of Santoshi is in last? Why no campaign did not start when there was Santoshi case? When upper caste Hindu daughter disappeared then every people unite. This is same style of Chanakya that he used Shudra Chandra Gupta and Vishkanya to satisfy his EGO.

I know that upper caste so-called progressive people forget the context and contribution of Dalits. eg. Radha Kumari in her book named "History of Doing" forgets the name of Savitri Bai Phule and her contribution too. I am raising this question that upper caste Hindus is doing politics of solidarity for their own benefit and wants to use the Dalit and marginalized forces for them. It is fox in the skin of sheep. Why they are silent on the hunger strike of Kranti Bhusan and attack on PVCHR?

My struggle against bonded labour and child labour in carpet and silk industries converted into initiatives and projects to various organizations, my brother Stalin was murdered and there were deadly attacks on me.

Subject: Responce on Lenin letter

We received a forwarded letter of Dr. Lenin. It is shoking. As far as we know, it has not been a tradition and not acceptable in any society including followers of Budhism to remind about the past in a crucial time, and thus negating the seriousness of the present. It is a genral belief that great problems and sorrowness unite sufferers.

May be VK Rai has not supported to Lenin, but it is not a proper time to mention. It is nothing but hurdling and harming effort in a cleverly carved frame.

The price of initiation on the issue of injustice met to Santoshi and not turning down despite of threatening, was primarily paid by Rachna Rai, not by her father VK Rai or his family & frinds. She became innocent target, only because leading role of her father in the protest for justice to Santoshi. After 19 days, there is no clue of Rachna Rai. At this challenging situation full of sadness, Lenin the great is unclothing the past when he was in trouble and VK Rai had not came forward, and posing and praising his greatness by saying that even then he did so and so regarding Rachna Rai episode.

Often children argue that they ill treated someone because sometime had been ill treated by the same. What is your age Dr. Lenin (ex Raghvanshi and now a boudh)?

Lenin blamed being discriminated, because he has a philosphical understanding towerds Ambedker Saheb and converted himself to Budhism. What he is indicating? Instead of holding firmly a play card of demands, he played a card like many Politians plays to devide people just for their own interests in the name of cast and belief.

Here are simply two questions.
· If Lenin having helthy relations with carpet industry?
· If he has been assigned a short time tender to creat confusion and weaken the emerging unity for joint action on this specific and immideate issue.

Everybody has right to express but here is also a limit. Crossing the limit is to violate the rights of others. Lenin knows better that inactivity only slowes justice but destructivity always leads and promotes injustice.

What a fun that so called champion is defeating the soul and essence of human rights. Lenin must remember that he has thoughen out many Dalit employee of his own organization and has been charged for sexual harresment also.

We are concerned with the issues to be solved and not interested at all to indulge ourselves in debating, questioning and counter questing. Question of people's vigilance on the Cammander of people's vigilance is secondary. And there is a long list of self proclaimed fighters.We cannot waste our time and enegy to gain zero. There are plenty of real and alarming questions to be addressed.

Fight against the state Terrorism

Since last few years PVCHR has been helping the member of the Musher community to raise their voice against bonded labour, starvation and malnutrition. Current village head of Belwa Mr. Rajendra Prasad Tripathi himself was charged with the case of employing bonded labour in his brick klin factory and two bonded labour Mr. Gehru and Mr. Bothu Mushar were released with the support of PVCHR and PVCHR member is also the member of the state Government sponsored district level committee against bonded labour. In this case current village head Mr. Rajendra Prasad Tripathi was sentenced to pay fine for restoring to bonded labour in his brick kilns.

Since then Mushar's were organizes by PVCHR, which directly challenged the upper caste upper caste domination of the Mushars in Belwa by the Brahmin community led by Mr. Tripathi. Simultaneously the PVCHR also started taking up cases of starvation and malnutrition in the lower caste particularly from Varanasi and other neighbouring district of Uttar Pradesh. AHRC report hunger alert on dozen of these cases, upon which the united nation agencies has initiated dialogues with Government of India. The cases of Mr. Visambhar, nine year old Seema Mushar, 18-month old Alina Shahin, Mr. Kammal Mushar starvation death cases from Varanasi district and three years old boy Pritam starvation death cases from Ambedkar Nager district.

When these cases were reported current state administration Ms. Mayawati took proactive step to address this issue. She personally intervenes in many cases. In this process several other political parties also started interest in this case. As of now starvation and malnutrition is the subject of political debate in the state.

When the cases of starvation and death from malnutrition were reported from Uttar Pradesh, Chief Minister convened a meeting in which strict action were suggested against the head of the district magistrate. It is juncture the death of Alina, Kammal and Pritam were reported the PVCHR and AHRC issued hunger alert upon it. The district administration (DM) Ms. Veena Kumari founded these report as a challenge to the magistrate's within the district and also as issues which are likely to bring the D.M office under fire from state capital.


In December 2007 PVCHR also planned to erect two monuments in Belwa. One was in the memory of the Mushars and other poor children who died from starvation in Belwa and other was the solemn oaths the member of Mushar and other marginalized families took in one folk school session. The content of the memorial and oath is in plain and simple language. The action was considered as yet another challenge by the D.M Ms. Veena Kumari. The D.M ordered local police to stop the function was refused by the D.M's office. To prevent the PVCHR and others human rights organizations from conducting the function in Belwa the D.M ordered police to register a case against PVCHR activist. For lodging, they choose the ever willing Mr. Tripathi, who also found the activities of the PVCHR as to be threatening to his family's Brahmin caste domination in the village. Accordingly a complaint was filed by Mr. Tripathi at the Phulpur police station that entertains jurisdiction over Belwa.


In spite of repeated reminder the Phulpur police station refused to produce anything in the court. Even though the laws mandates a report to be filed by the police in the court within 48 hours. The police filed a report after 10 days informing the court that the crime has been registered. In the mean while PVCHR activist against whom the crime was registered also appeared in the court informing that they are present in with in the jurisdiction of police and public in case if the police wanted to be arrest. The police however refused to arrest them.


Now it is known they that police is planning to file yet another fabricated report in court starting that the accused are absconding and avoiding arrest are planning to request the court to issue process directing local police and the administration to proceed against the property of PVCHR activists meaning the PVCHR office. The intention is to raid the PVCHR office as if in compliance of the court's order and to destroy whatever that is maintained at the offices in the form of records and other working equipments like computers and other office equipment.

· Kalawati w/o Sri Sher Bahadur & Prem Kumar vs. State of U.P through its secretary ministry of home, Station house officer Phulpur police station and Rajendra Prasad Tripathi petition no is 2069 of 2008. The case was present before Honorable Judge Mr. Imtiyaz Murtuza and Mr. K.N Ojha.

As above all cases are similar the judgment given by the honorable justice is given below:

The petitioner through the present writ petition has invoked the extraordinary jurisdiction of this court under Article 226 of the Constitution of India praying for a writ order or direction in the nature of certiorari quashing the impugned FIR dated 9.12.07 related to the case crime no. 357of 2007 under Section 505-B IPC police station Phulpur, District Varanasi the ancillary prayer is to issue writ of mandamus commanding the respondents not to arrest the petitioner/ petitioners in the aforesaid crime number pendent lite the writ petition.

We have heard learned counsel for the petitioner at a great length and learned AGA and have perused the impugned FIR.

Learned counsel for the petitioner contended that since action was taken by the petitioners against the respondent no. 3, therefore malicious first information report has been lodged and the petitioner has been falsely implicated in the aforesaid offence. It is further contended that the arrest of co accused has been stayed in the criminal Misc. petition no. 1368 of 2008.

Learned counsel of the petitioner is directed to serve respondent no. 3 through RPAD within a period of a week from today. Respondent no. 3 as well as learned AGA may file a counter affidavit within three weeks. Learned counsel for the petitioner will have one week thereafter to file rejoinder affidavit.

However on facts of the present case the petitioner shall not be arrest in the aforesaid crime number for the aforesaid offences till the next date of listening.


In 2002 a first information report was filed against Rajendra Prasad Tripathi by Dr. Lenin Raghuvanshi in his capacity as member of the Committee on Bonded labour. A warrant was consequently issued for Rajendra Tripathi arrest, which is still pending. It is not known why Rajendra Tripathi was not arrest when he presents himself at the police station to file the FIR against Dr. Lenin Raghuvanshi: however it could be seen to indicate degree of collision between police and the local authorities.

Charge sheet was filed by enquiry police officer in Deputy Superintendent Office. Looking all these aspect it is necessary for re- investigation for the fair trial.

Fighter for the rights of the untouchables

Today/Tomorrow, 14 April 2008, the father of the Indian constitution and fighter for the rights of the untouchables (Dalits) would have turned 117. On the occasion of that birthday the Varanasi based People's Vigilance Committee on Human Rights (PVCHR) launched the Ambedkar Online Memorial. Zweitägiges Drachenfest wird zur völkerverbindenden Aktion
Als Indien am 15.August 1947, nach einer mehr als 200 Jahre dauernden Fremdherrschaft durch die Britten seine Unabhängigkeit erlangt, war es zugleich der Geburtstag der größten Demokratie der Welt. In verschiedenen Regionen Indiens, vor allem in und um Ahmedabad im Bundesstaat Gugarat, haben am indischen Unabhängigkeitstag Drachenwettkämpfe Tradition. Tausende von „Windvögeln" in allen Farben, Größen und Formen, die die Freiheit des Landes symbolisieren sollen, fliegen dann von Balkons und Dachterrassen aus in die Lüfte. Das ist der Multikulti-Hintergrund des zweitägigen „Drachenfestes" am kommenden Wochernende im Gewerbegebiet Eichholz in Bergisch Born. Die Deutsch-Indische Gesellschaft, der städtische Kulturservice, die städtische Kinder- und Jugendförderung und der Drachenexperte „Drachenmichel" erwarten dazu am Samstag, 11. August, ab 10 Uhr viele Jungen und Mädchen aus Kindertageseinrichtungen, Schulen und der Musik- und Kunstschule zu einem Workshop im Drachenbau, zu Drachenwettkämpfen und „freiem Fliegen". In der Dämmerung werden beleuchtete „Nachtdrachen" aufsteigen, sicherlich ein spektakuläres Bild. Am Sonntag, 12. August, 11 Uhr, wird das Drachenfest dann zu einer völkerverbindenden Aktion; denn nicht nur in Bergisch Born, sondern auch im indischen Varanasi werden dann Drachen aufsteigen, um auf die Kinder aus der Kaste der Dalit aufmerksam zu machen, die noch immer in Unfreiheit und sozialer Ungerechtigkeit am Rande der indischen Gesellschaft leben.
Der PVCHR - PEOPLE'S VIGILANCE COMMITTEE ON HUMAN RIGHTS ( Verband zur Überwachung der Menschenrechte) arbeitet in den Dörfern rund um Varanasi und in weiteren 80 Distrikten unter der Leitung von Dr. Lenin Raghuvanshi für und mit den Dalits, den Unterprivilegiertesten der indischen Gesellschaft, für deren Rechte auf ein menschenwürdiges Leben. Der PVCHR konnte so bis heute den Lebensstandard von tausenden Männern, Frauen und Kindern der Dalit verbessern. Vor fünf Jahren überzeugte sich Helma Ritscher, die Vorsitzende der Deutsch-Indischen Gesellschaft Remscheid (DIG Remscheid), zum ersten Mal vor Ort von der Lebenssituation der Dalits. Seitdem arbeiten PVCHR und DIG eng zusammen, und die DIG hat bei verschiedenen Anlässen in Remscheid auf die Lebenssituation der Dalits aufmerksam gemacht. Anfang 2006 kam so eine Zusammenarbeit mit dem Röntgen-Gymnasium (Direktor H.-Helmut Hammes) zustande. Rögy SchülerInnen gründeten mit ihrer Lehrerin Gisela Loosen, ein „Dalit-Team" unter dem Motto „Together in friendship for Dalits'rights" und setzten sich etwa beim Weltkindertag 2006 für für die Dalits ein.
Im Dezember 2006 erhielt die DIG Landesmittel für den Ausbau von zwei Dalit-Schulen in den Dörfern Ayer und Shivrampur. Helma Ritscher überbrachte das Geld im Februar 2007. Bei dieser Gelegenheit wurde im Dorf Ayar / Shivrampur nahe Varanasi das „Austausch-Kindergarten-Projekt" zwischen IKE- Förderverein für Interkulturelle Erziehung e.V., DIG und dem PVCHR für Mushahar-Kinder (Unterkaste innerhalb der Dalitgesellschaft) ins Leben gerufen. Auch vermittelte Helma Ritscher den Austausch von Briefen zwischen den Rögy-SchülerInnnen den Panchayats (Kinderräten) in den drei Partnerdörfern Shivrampur, Baghawanala und Belwa. Indra aus Shivrampur schrieb damals: „Ich bin so glücklich über diese Freundschaft. Ich fühle mich jetzt viel stärker im Kampf um unsere Rechte."
Obwohl das Kastenwesen am 26. Januar 1950 mit der Gründung der Republik Indien in der Verfassung abgeschafft wurde, existiert es nach wie vor zum Nachteil von ca. 15 Prozent der Gesamtbevölkerung in ca. 80 Prozent aller indischen Provinzen. Es sind die Randgruppen der indischen Gesellschaft, Dalits und Adivasis (Tribes-Urstämme Indiens), die davon betroffen sind.
Das Kastenwesen besteht aus vier Kasten. Diejenigen, die aus diesem System herausfallen, werden die „Unberührbaren" genannt. Dalit ist die Eigenbezeichnung der sogenannten „Unberührbaren". Dalit bedeutet „ niedergedrückt" „gebrochen". Mit der Verwendung dieses Wortes wollen Dalit ein neues Selbstbewusstsein und eine soziale Anklage ausdrücken. Gewalt, Diskriminierung und Unterdrückung gegenüber den Dalit sind an der Tagesordnung. Verfassung und Gesetze werden von Höherkastigen systematisch missachtet und die Behörden stellen sich meist auf die Seite dieser ökonomisch und politisch Mächtigen. Die Mehrzahl der Dalit hat geringen Zugang zu Landreformen und Sozialprogrammen. Sie verrichten die niedrigsten Berufe und Tätigkeiten, weil drei Viertel von ihnen keine Schulbildung haben.
